Limited Warranty
Custom Quality Marble, Inc. (CQM), at its option will either repair or replace
any product manufactured by CQM, if a defect in materials or workmanship
exists. Slight variations in color, tone, and pattern may exist from piece
to piece or from mix to mix. Age may also affect color or tone. These variations
are not a warranty item. Warranty claims must be accompanied by a copy of
this warranty, invoice, and proof of payment. This limited warranty is effective
for ten years from the date of billing or from closing date for new construction.
However, warranty shall not exceed 120 months from billing date. CQM’s
warranty shall not exceed the warranty given by a supplier of an item sold
by CQM, Inc. Any items picked up at CQM must be returned to CQM, for warranty,
repair or replacement; otherwise, there will be a charge for pick-up/removal,
delivery/installation and transportation. Customer is solely responsible
for providing access to items needing warranty attention. Customer must
report damaged merchandise or blemished merchandise within three working
days of installation date or date picked up. CQM will not cover under warranty
any merchandise damaged by any source other than its employees.
Warranty is void if customers account is not paid in full. This is the
sole and exclusive remedy for defective items. There are no other warranties,
expressed or implied. All implied warranties, if any, shall be limited
to the scope and duration of this limited warranty. Also, CQM will not
be responsible for any direct, incidental, or consequential damages that
are caused by defective product. CQM's liability is limited solely to
the cost of the product sold. This contract is to be performed in Travis
County, Texas.
All persons installing our products shall have full responsibility for
knowing the proper installation procedures. Damages or failures of any
of our products due to improper installation of our products by persons
not employed by CQM are not covered by this warranty.
